Definitions

"You" /"Your" means the user(s) of the website for the purposes of advertising or searching for properties for sale.
"We" /"Us" /"Ours" means Renturhome Ltd, trading as Renturhome.co.uk (registered in England and Wales, company number 05517312) with the registered office at

Royal House, Market Place, Redditch, Worcestershire. B98 2AA.

"Property Advertising" means submitting details of a property to the website for the purpose of advertising it as being for let to the general public.
"Property Searching" means using The Website and any facilities provided by The Website and Renturhome Ltd to identify properties to let on The Website.
"The Website" means the website(s) of Renturhome Ltd and associated websites.
"Services" means products and services made available to users of the Website that are provided by organisations other than Renturhome Ltd.
"Account" means the account you create on the Website to contain your personal details and through which you can submit Adverts to the Website or search for properties on the Website.
"Advert" means placing information about a specific property on the Website that is available to let.
"Contact Details" means the way in which You have indicated that you prefer to be contacted by people or businesses engaging in Property Searching.
"Published / Publish / Publishing" means the displaying of an Advert on the Website.

You acknowledge and understand that:

We are NOT an estate agent as defined by the Estate Agents Act 1979 and do not purport to operate as an Estate Agent. We are not a letting agent and do not purport to operate as a letting agent. We accept no responsibility for the property being let and or the conduct of the landlord or tenant.

You are responsible for all negotiations, administration and representations required to let a property Published on The Website.

By undertaking Property Advertising and or Property Searching, You are not appointing Us to represent You or act on Your behalf in the letting of a property.

We will not enter into any negotiation with You or on Your behalf to facilitate the letting of a property.

We do not give any guarantees that Property Advertising will result in a property being let.

All adverts on the Website are the responsibility of individuals or businesses whom submitted them and have not been verified by Us. We do not give any warranties or representations to the accuracy of any information, description, detail or similar.

You are responsible for making all checks and assessments of people that You enter into negotiations with to let a property and We cannot be held responsible for the suitability of people or property You enter into negotiations with regarding a property.

Intellectual Property & Copy Right

The copyright and all other intellectual property rights in the Website including but not limited to all trade marks, service marks, trading names, text, graphics, code, files and links, belong to Us or Our licensor(s). You must not copy, transmit, modify, republish, store (in whole or in part), frame, pass-off or link to any material or information on or downloaded from this Website with the exception of Publishing Adverts for the purpose of Property Searching, without our prior written consent.

Property Advertising

By engaging in Property Advertising you acknowledge and understand that:

You are authorised to advertise the property to let.
You agree to Us publishing these details on the Website and any other media that We may choose from time to time.
The details supplied by You accurately describe the property being Published.
You have title to or have obtained authority to submit photographs of the property to the Website.
All photographs submitted to the Website are of the property to be Published and are decent and legal.
We are not liable for any unauthorised, illegal or indecent photographs submitted to the Website by You or other customers. However, We will endeavour to remove any such material as soon as possible following notification or identification.
Photographs and text depicting, describing or making reference in any way to pornography, terrorism, racism, sexism, criminal activity of any sort is not permitted to be submitted by You to the Website and that submission of such material will result in Your Account and Advert being removed from the Website and You will not be entitled to a refund.
On receipt of cleared payment or credit or debit card authority or any other agreement We make with You to pay for Your Advert, Your Advert will be Published on the Website within 24 hours. If You are granted credit terms with Us, failure to pay the outstanding balance detailed on invoices We send to You by the due date will result in ALL properties within Your account not being visible on the Website until payment is made.
If the Advert is not visible on the Website thirty six hours from payment being received by Us, You will be entitled to a full refund and it will be Your responsibility to request a refund.
You will be contacted by people, businesses, government entities and others using the Contact Details for the purpose of negotiating the letting of the property being advertised by You. We are not liable if these parties use the Contact Details for purposes not associated with the letting of a property.

Property Descriptions

The person or business Publishing the Advert is responsible for ensuring that all descriptions provided for an Advert are true, honest and not misleading and will be liable for any complaint, prosecution or similar for providing descriptions that are not true, honest or are misleading and that We are not responsible for incorrect property descriptions.

Advertise Until Let

Adverts will be published on the Website until removed by You or fourteen (14) days from non-receipt of payment.

Amending Property Advertising

You can amend the Advert details at any time whilst the property is published on the Website, with the exception of the property address which cannot be altered once payment has been received by Us.

Cancelling Property Advertising

Once payment is received, the Advert will be Published on the Website within 24 hours. By making payment for the Advert and by Your Advert being Published you acknowledge that Property Advertising commences immediately and in accordance with the Distance Selling Regulations 2000, you agree to waive the right to the statutory cancellation period of seven (7) days.

Property Searching

By engaging in Property Searching you acknowledge and understand that You will use Contact Details only for the purpose of enquiring about an Advert and that You will not transfer Contact Details to any person or business.

Search & Send

Search & Send is a facility provided by Us to forward details of property adverts to You based on criteria determined by You. We endeavour not to forward the same property within six (6) months from the date it was originally forwarded to You, however We cannot guarantee that this will not occur due to the property being re advertised or due to systems error.

We will aim to forward Adverts that meet Your criteria within 48 hours of the Advert being Published on the Website. We will forward the Advert reference number to Your Account and where requested, Your email address and or mobile telephone by SMS.

Forwarding Adverts to email addresses and to Your Account will be free of charge to You. However We reserve the right to make a charge for this by giving you 30 days notice which will be notified to You by email, in writing, SMS or by notice on Your Account. At this time you will be given the option of terminating your Search & Send Facility if you do not want to be charged for this.

If you choose to have Adverts forwarded to you by SMS this is a subscription service , it will cost £2.99 per month. We reserve the right to change this charge. At this time you will be given the option to terminate your Search & Send Facility if you do not want to be charged an increased rate for the service.

Where Adverts are forwarded to Your mobile telephone by SMS you can text the word 'STOP' to Us and We will cease forwarding adverts to You by SMS.

We do not accept any liability for any loss or distress caused by Our failure to forward details of any Advert.

We reserve the right to change the Search & Send service at any time with giving your prior notice.

Viewing Request Forms

We will endeavour to forward Viewing Request forms to You within 24 hours of the form being submitted

Forwarding Viewing Request Forms to email addresses and to Your Account will be free of charge to You. However We reserve the right to make a charge for this by giving you 30 days notice which will be notified to You by email, in writing, SMS or by notice on Your Account. At this time you will be given the option of terminating your Search & Send Facility if you do not want to be charged for this.

If you choose to have notification of a Viewing Request Form being submitted by SMS this is a subscription service , it will cost £2.99 per month.

Where Adverts are forwarded to Your mobile telephone by SMS you can text the word 'STOP' to Us and We will cease forwarding adverts to You by SMS.

We do not accept any liability for any loss or distress caused by Our failure to forward details of any Viewing Request Forms

We reserve the right to change the Viewing Request Form service at any time with provision of prior notice to You.

Charges & Payment

Our charges are detailed in the pricing schedule and we reserve the right to change our charging without notice unless detailed otherwise.

All charges will be made in UK sterling.

All payments must be made by direct debt from a suitable bank or building society account or credit, or debit card The types of payment method accepted will be determined by Us and may change from time to time.

All payments will be debited to the bank or building society account, credit or debit card immediately and will appear on Your statement as 'Renturhome'.

For purchases of Property Advertising and Search & Send services or To Let sign boards, using Credit or Debit card an invoice will be displayed following payment for You to print or save. A copy of the invoice will be sent to You via email within 3 days of the payment being made.

For purchases of Property Advertising and Search & Send services using direct debit, the first payment must be made by Credit or Debit Card. An invoice will be displayed along with the Direct Debit guarantee. A copy of the invoice and direct debit payment details will be sent via email within 3 days of the first payment being received.

Direct debit payment claims will be made in accordance with payment date as detailed on Your invoice. To cease payment by direct debit You will be required to notify Us in writing 14 days prior to the date Your payment is scheduled to be made.

In exceptional circumstances We may accept payment by cheque or money order and if We do We will make an additional charge to cover the cost of processing this payment.

If a chargeback claim is made against Us and Your claim is not upheld We reserve the right to recover any costs incurred by Us from You.

Refunds

If Your Advert is not Published on the Website within thirty six (36) hours of full payment being received by Us You will be entitled to a full refund.

Where You have requested a To Let sign board and the board has not been received by You within fourteen days (14) of full payment being received by Us, You will be entitled to a full refund of the money You paid for the To Let sign board.

Refunds will not be granted for the cost of Search & Send services if a property is not forwarded to you because there are not any properties that match your criteria.

To Let Sign Boards

You acknowledge and understand that We will deliver the board and supporting pole disassembled and that it is Your responsibility to assemble and erect the board.

You are required to ensure the erection of To Let sign boards do not contravene any planning regulations and trespass laws.

On receipt of Your To Let sign board You are required to check the details to ensure they correspond to the Advert reference number. If the details are incorrect and notified to Us within 14 working days of being received by You, We will provide You with new sign details without charge. If You Notify Us after this time, We will make a charge to cover our costs.

We will endeavour to deliver the To Let board within 3 working days from the date payment is received by Us.

You agree that To Let sign boards will contain a reference number and telephone number allowing the public to obtain details of the Property by SMS.

We reserve the right to cease provision of To Let sign boards at any time without giving you prior notice. If we cease provision of To Let sign boards and We have received payment for such a Sign Board, You will be entitled to refund of the cost paid by You for the To Let sign board.

Cancelling To Let Sign Boards

By making payment for the To Let sign boards you acknowledge that Your To Let sign board is unique to You and in accordance with the Distance Selling Regulations 2000, you agree to waive the right to the statutory cancellation period of seven (7) days.

Use of Your Data

Your personal details are held on a secure database. Where accepted by You, we will share Your information with organisations that We believe can offer You Goods and Services that We believe to be relevant to You. See our Privacy Policy.

Services

We provide access and links to organisations that provide goods and services that will assist You in letting a property. Payment for the Services may be paid directly to the service provider or to Us for the Service. Where payment for the Services is made to Us We will work with the provider to ensure You receive the Services in accordance with the specific terms and conditions of the Service purchased. We do not make any warranty to their suitability for Your specific needs or the quality of the Service.

Liability Limit

Nothing in these Terms will be deemed to exclude Our liability to You for death or personal injury arising from Our negligence, or for fraudulent misrepresentation.

We will not be liable for any failures due to software or Internet errors or unavailability, or any other circumstances beyond Our reasonable control.

We do not accept any liability for loss of your password or account ID caused by a breakdown, error, loss of power or otherwise caused by or to your computer system.

We accept no liability for any loss suffered as a result of Your use of the Website or reliance on any information provided on it and exclude such liability to the fullest extent permitted by law.

Service Availability

We intend the Website to be available 24 hours per day 7 days per week. However there will be a requirement to conduct essential maintenance and development to the Website which will affect availability. We cannot be held responsible for any interruption in the Website availability caused by circumstances beyond Our control, including but not limited to hacking, virus, software failure, Your internet service provider, Your hardware and software, Our website host provider and software failure.

Complaints

If You experience any problems with the service We provide, please notify Us immediately and We will try to resolve the issue as soon as possible.

Please quote Your Account number or property reference number in all communications. We will respond to all enquiries within 2 working days.

Law

The prevailing law of England and Wales shall be applied in interpreting these terms and conditions and all disputes will be settled in the English courts.
